Terms & Conditions

This website is operated by: Cornish Wooden Craft Your use of this website is subject to Your acceptance of our terms and conditions as detailed below.

  1. DEFINITIONS:

    1. Where YOU are dealing as a consumer YOUR statutory rights are not affected by these CONDITIONS.  'CONDITIONS' means the conditions set out in this document and any additional or special CONDITIONS agreed in writing by us 'ORDER' means the order recorded in writing To Cornish Wooden Craft Only an order form Or Quote detailing the GOODS.

    2. ‘CONTRACT' means the contract for the sale of the GOODS which is governed by the laws of England and any dispute between YOU and US will be resolved through the Courts of England.

    3. 'DELIVERY DATE' means the date or dates as set out in the ORDER or otherwise confirmed by US or notified to YOU in writing when the GOODS  are to be delivered.

    4. 'GOODS' means the items YOU agree to buy from US as detailed in the ORDER or otherwise specified in writing.

    5. 'WE' or 'US' or 'OUR' means Cornish Wooden Craft, and shall be deemed to include our employees and agents (but not independent contractors).

    6. 'YOU' or 'YOUR' means the person, business or company who purchases or agrees to purchase the GOODS from US.

    7. 'STANDARD PRODUCT' means GOODS that are selected by YOU from OUR standard range of products.

  2. ORDERING:

    1. YOU may choose to either register an account or simply use the website as a guest.

    2. Our range of STANDARD PRODUCTS can be selected directly and added to YOUR shopping basket.

    3. For consumer transactions WE accept all major credit and debit cards and Bank Transfer payments. We do not charge fees for card transactions.  Maximum Card spend £1000.00. For orders where the amount is above £1000.00 the balance would need to be paid via an alternative method.

  3. DELIVERY:

    1. WE shall give YOU reasonable notice of the DELIVERY DATE. Any dates quoted for delivery of the GOODS are approximate only (and assume no delays in payment terms as per invoice/ORDER, Where upon time shall not run for the purposes of this clause) and WE shall not be liable for any reasonable delay delivery/performance arising from any circumstances beyond OUR control or by failure by YOU to give adequate instructions or any other default by YOU.

    2. YOU agree to provide US with full and proper address details sufficient to clearly identify the delivery address.

    3. YOU agree to advise US if there are any difficulties regarding access from the public highway to the address where the GOODS will be delivered.

    4. If YOU fail to take delivery of the GOODS (otherwise than by reason of OUR fault) by the DELIVERY DATE then without prejudice to any other right or remedy available to US WE may either store the GOODS until actual delivery and charge YOU for the reasonable costs (including transportation and insurance) of storage and charge YOU for all reasonable labour costs incurred by US or sell the GOODS at the best price readily obtainable and (after deducting all reasonable storage and selling expenses and all other reasonable costs incurred by US) account to YOU for the excess over the price or charge YOU for any shortfall below the price.

    5.  WE shall be entitled to deliver the GOODS (whether under this CONTRACT or any other CONTRACT) by instalments of any size and in any order although WE shall endeavor to deliver the GOODS at dates as close to each other as possible.

    6. DELIVERY TIMES FOR ORDERS TAKEN FROM 01/05/2019 STANDARD ITEMS 1-7 Working days from acceptance pf order

    7. DELIVERY FOR OVER SEAS: WE will deliver to any UK mainland portside of you choosing -at that point the free delivery Ends.  The full cost is to be covered by yourself to have the product/s brought to your chosen Location.   WE can help arrange this if you want us to PLEASE NOTE all costs incurred are to be covered by customer in advance. Free delivery is to a UK port ONLY.

  4. PRICE AND PAYMENT:

    1. All prices shown are in British Pounds Sterling (GBP).

    2. Unless otherwise agreed in writing, YOU must pay the price in full at the time of the ORDER.

    3. Invoices will be supplied via email, it is YOUR responsibility to check the invoice and report any discrepancies in size or specification as soon as possible, but no later than 2 working days from the invoice date.

  5. SPECIFICATION:

    1. YOU acknowledge and agree that the CONTRACT specification shall reflect that timber is a natural product and variation in the finished surface, colour and grain is inevitable.

    2. YOU acknowledge and agree that wood is a natural product and that knots, sap leakage, splinters, splits, contraction and expansion may occur.

  6. RETURNS POLICY:

    1. INCORRECT GOODS - YOU must notify US of any GOODS delivered that were not as ordered within 48 hours of delivery. If the items are not as ordered, YOU must not open, use or install the GOODS, otherwise WE will consider that YOU have accepted the goods. WE will refund the cost of the incorrect goods including all reasonable costs incurred by YOU in the return of the goods subject to YOU complying with OUR Returns Procedure in condition 7 a..

    2. DAMAGED GOODS - YOU must notify US of any GOODS that were delivered in a damaged condition within 48 hours of delivery. Where possible YOU must inform the courier of the damage and either accept delivery noting the damage or refuse the delivery. WE will refund the cost of any such damaged GOODS including all reasonable costs incurred by YOU in the return of the goods subject to YOU complying with OUR Returns Procedure in condition 7 a.

    3. FAULTY GOODS - YOU must notify US of any GOODS that are faulty as soon as possible. YOU must cease using any faulty GOODS immediately and contact US via email or telephone. Depending on the length of time YOU have had the GOODS WE may offer YOU a repair, replacement or refund. If WE agree that the GOODS are faulty, WE will refund all reasonable costs incurred by YOU in the return of the GOODS subject to YOU complying with OUR Returns Procedure in condition 7 a.

    4. UNWANTED STANDARD GOODS BEFORE DELIVERY- If YOU change YOUR mind for any reason before dispatch of the STANDARD GOODS ordered, WE will refund YOU the original purchase cost (including any delivery costs charged by US). This condition does not apply if YOU are not acting as a consumer.

    5. UNWANTED STANDARD GOODS AFTER DELIVERY- If YOU change YOUR mind for any reason within 14 working days of the receipt of the STANDARD GOODS ordered, WE will refund YOU the original purchase price (including any delivery costs). YOU must not have used the GOODS to the extent of altering, drilling, painting or sealing and YOU must return them to US in compliance with our Returns Procedure in condition 7 a. at YOUR expense. If YOU wish to return the STANDARD GOODS after 14 working days WE may, at our discretion, accept the return of the GOODS at YOUR expense, subject to a restocking charge of 35% of the original price (including any delivery costs). This condition does not apply if YOU are not acting as a consumer.

  7. REFUND POLICY:

    1. Any refunds offered or agreed will be made back to YOUR original payment method within 14 working days.

  8. RETURNS PROCEDURE:

    1. YOU must EMAIL US to email@cornishwoodencraft.co.uk to obtain a Return Merchandise Authorisation (RMA) number before returning any GOODS. This number must be clearly shown on the outer packaging of the returned GOODS and the RMA number must be quoted in any subsequent correspondence. Any returned GOODS, must be securely packaged and sent to: Cornish Wooden Craft the address for returns will be given with the RMA Number via email.

  9. CANCELLATION PROCEDURE:

    1. All cancellations must be in writing to  email@cornishwoodencraft.co.uk only.  Any other method of cancellation will NOT be accepted.

  10. WARRANTIES GUARANTEES AND LIABILITIES:

    1.  When YOU are acting as a consumer WE will pass onto YOU the full benefit of any manufacturer's or supplier's guarantee available in respect of the GOODS.

    2.  When YOU are not acting as a consumer all GOODS are provided on an “As is” basis and to the fullest extent permitted by law, WE exclude all representations and warranties (whether express or implied) including the implied warranties of satisfactory quality and fitness for a particular purpose.

  11. FORCE MAJEURE:

    1.  WE shall not be liable for any delay in performing or failure to perform due to any Act of God, war, strikes, lock-out, industrial action, fire, flood, drought, tempest or any other event beyond OUR reasonable control. Such delay or failure will not constitute a breach of this CONTRACT and time for the performance of the effected obligations will be extended by such period as is reasonable.
